Colleton County Circuit Court Overview
The South Carolina Judicial Branch describes Circuit Court as the state's court of general jurisdiction. In Colleton County, Circuit Court is part of Judicial Circuit 14. Circuit Court vs Summary Courts
South Carolina court names matter because the record keeper changes by court level. Circuit Court is the general-jurisdiction trial court. Family Court is separate for domestic and juvenile/family matters. Probate Court is a county-level court for estates, marriage licenses, guardianships, conservatorships, minor settlements, and involuntary commitments. Magistrate and Municipal Courts are lower summary courts, with traffic and lower-level criminal jurisdiction in Colleton County.

Colleton County Case Flow

Colleton County Court Divisions
Common Pleas is the civil division of Circuit Court. The Colleton Clerk accepts and maintains records for Common Pleas disputes, prepares upcoming Common Pleas rosters, and maintains records of Common Pleas judgments. General Sessions is the criminal division. The Clerk's Office says it maintains General Sessions records that include sentence sheets, arrest warrants, tickets, bonds, indictments, and pleadings. General Sessions fines may be paid by cash or money order; personal checks are not accepted.
Family Court is not a Circuit Court division, but it is important for Colleton County record search because the Clerk supports Family Court records. Family Court handles divorce, legal separation, custody, visitation, support, adoption, termination of parental rights, alimony, division of marital property, and name changes. Child support payment questions are handled by the South Carolina State Disbursement Unit, while some child support filing routes begin at the Clerk's Office.

Colleton County is in Judicial Circuit 14. Colleton County Treatment Courts
The South Carolina Judicial Branch identifies Treatment Court as a trial-court category. In the Fourteenth Judicial Circuit, the Solicitor announced a Multidisciplinary Court expansion to Colleton and Jasper counties. The local official name in the Solicitor material is Multidisciplinary Court. The program was described as an alternative to prison for non-violent offenders whose crimes are tied to chemical addiction or the effects of military service, including PTSD.

Federal Court Outside Colleton
Federal records are not Colleton County Circuit Court records. Colleton-area federal cases fall under the U.S. District Court for the District of South Carolina and are searched through PACER or the federal court's electronic systems. South Carolina has one U.S. Bankruptcy Court district serving the entire state. Federal appeals go to the Fourth Circuit Court of Appeals.
